Immigrants arrive in and exit the Republic of Kazakhstan through the entry border points, open for international and passenger service of the Republic of Kazakhstan on passports or equivalent identity documents, and visas of the Republic of Kazakhstan, unless otherwise is provided by the statutes of the Republic of Kazakhstan and/or international agreements, ratified by the Republic of Kazakhstan.
Immigrants, who temporarily stay in the Republic of Kazakhstan more than five calendar days from the day of crossing the State Border of the Republic of Kazakhstan, should have temporary resident permit (registration), unless other procedures are established by virtue of agreement between the Republic of Kazakhstan and relevant party or by the Government of the Republic of Kazakhstan
The immigrant do not need to register their passports if they:
1.Hold diplomatic or service passports;
2.Arrive in the Republic of Kazakhstan on “diplomatic”, “service”, “investors” visa of the Republic of Kazakhstan or have status “investor” to be confirmed by the authorized agency of the Republic of Kazakhstan for investments (for visa free regime states);
3.Under the age of 16 years.From 16 July, 2015 to 31 December, 2017 citizens of the Commonwealth of Australia, the Italian Republic, the Principality of Monaco, the Kingdom of Belgium, the Kingdom of Spain, the Kingdom of the Netherlands, the Kingdom of Norway, the Kingdom of Sweden, Malaysia, United Arab Emirates, Singapore, the United Kingdom of Great Britain and Northern Ireland, the United States of America, the Federal Republic of Germany, the Republic of Finland, the French Republic, the Swiss Confederation and Japan, arrive in and exit the Republic of Kazakhstan without visas should the period of their staying does not exceed 15 calendar days.
ENTRY TO THE OTHER REGIONS
When the immigrants move to other regions of the Republic of Kazakhstan for more than five calendar days or change temporary residence place in the Republic of Kazakhstan, the hosting individual or legal entity should communicate this in written to internal affairs bodies within three business days by filing a standard form as annexed to Rules No.83.]
CHANGE OF RESIDENCE PLACE
The immigrants should re-register within five calendar days with the local internal affairs bodies in place of new residence, when they change permanent or temporary residence place. When the migration police register immigrants, who arrive for temporary staying, they should communicate local police officer the permitted period of staying in that place through the internal affairs bodies.
The staying period of immigrants is extended through the issuance of new or extending the existing visas’ period or through extending passport registration period as per the request of an individual or legal entity hosting the immigrant or of an immigrant. The officers of internal affairs bodies extend the staying period by entering the data into the SIS “Berkut”.
LOSS OF PASSPORT
In the event of loss of passport, an immigrant should immediately file a letter with a local internal affairs body, in which he/she should describe when, where, and how the document has been lost. Subject to the immigrant’s letter, registered as per the established rules, and whose identity is determined, the migration police office should issue a note that should be given to a foreigner in case of loss of passport or an equivalent of the document as per form annexed to Rules No.83 (clause 16, Rules No.83).
Based on the issued note, a foreigner should receive a new passport or equivalent identity document in the consular officers of his/her state, where his/her exit visa will be put.
Every immigrant should be given an immigration card upon entry into the Republic of Kazakhstan. The card is given at the entry points at the state border, at the place of temporary or permanent residence or on the route.
The migration cards are not given to:
1) persons, having diplomatic, service or investor visas of the Republic of Kazakhstan, and also holders of diplomatic and service passports and confirmation of status of investor from the authorized state agency for investments;
2) Persons under the age of 16 years;
3) Flight, sea craft and river boat members;
4) Train crew members, including refrigeration and locomotive crew members and cargo attendants going by rail;
5) Train passengers transiting the territory of the Republic of Kazakhstan;
6) Drivers of international transport vehicles.
However, when persons, indicated in points 3), 4), 5) and 6) stay in the Republic of Kazakhstan more than five calendar days from the day of crossing the state border, they should register with the local internal affairs body.
The migration card contains information on immigrant, arriving in the Republic of Kazakhstan and is the basic tool for control of its temporary staying in the territory of the Republic of Kazakhstan
